  • How do I know if I am eligible to make a claim for medical negligence?

    Negligence is a very specific concept, and not every failure or error made by a health care provider will be negligent. The key question will be whether the care or advice fell below a level which was widely accepted as competent treatment by a peer opinion at the relevant time, in Australia.

  • How is medical negligence proved?

    It is essential to prove that the negligence caused or contributed to the injuries for which compensation is being claimed. This is often the most difficult aspect of a claim. Treatment may have been provided in a negligent way but if no harm or injury results a claim will probably not be viable.

  • What are some examples of medical negligence?

    There are many examples of medical cases as there are different types of medical advice & treatment.

  • How are legal fees decided?

    There are many different ways to calculate legal fees. Fees may be decided using an agreed hourly rate (usually for commercial litigation matters) or by using official court scales or other statutory scales (for some personal injury matters) which set out what should be charged for a particular task.

  • What sorts of gifts can I leave to a beneficiary?

    Can I make a conditional gift to a beneficiary (e.g. a gift to my spouse on condition that they use it to look after our children or a gift to a child on condition that they use it to buy a house)? Excluding a spouse, child or dependant.

  • How many lawyers in the firm specialise in asbestos litigation?

    If your case is complex or if it has to go to trial, you'll need to be able to match the resources of a big city insurance law firm when your case goes to court. Does your law firm have a team of specialist asbestos lawyers who have run trials before?

  • What is a general power of attorney?

    A general power of attorney allows your attorney to act on your behalf in relation to any financial transactions. It can be useful to ensure that during temporary absences such as overseas travel your financial affairs are being looked after. However, if you become incapable of providing your attorney with clear instructions this document will automatically become invalid.
