      Motor Vehicle Accidents: If you have been injured when driving a motor vehicle, as a passenger in a motor vehicle or as a pedestrian you have the right to claim providing the injury was caused by the negligence of another person. Workers Compensation: You have the right to claim providing you have suffered an injury by accident arising out of or in the course of your employment or whilst acting under your employers instructions. Super Claims: If you are unable to work due to an illness or disability, you may be able to gain early access to your superannuation fund or insurance, whether or not your illness or injury was work-related.

      Criminal Injury: Victims of crime have a right to compensation when they have suffered injury or loss as a result of an offence committed in WA. Compensation is paid by the State Government under the Criminal Injuries Compensation Act. Public Liability: Covers all injuries that occur in public places. From accidents in shopping centres, carparks or common property of units etc. where the injury occurs due to negligence on the part of the shopping centre owner, the council or body corporates.

      How is my claim settled?

      1. Through offers 2. By informal conference 3. Pre-trial conference 4. Trial: In the majority of cases matters are settled by way of conference. The final settlement decision remains your responsibility at all times.


      What is a pre-trial conference?

      A pre-trial conference is a meeting where all parties can discuss and explore the possibility of settlement. Your solicitor will advise you of the suitability of offers put forward and will support you in reaching a decision.


      What can I claim for?

      Depending on the nature and circumstances of your injuries you may be able to claim for any of the following: pain, suffering and loss of enjoyment of life physical or emotional trauma loss of past or future income hospital and medical treatment and other related expenses including future medical costs rehabilitation and retraining costs travel expenses legal costs.


      When do I settle my claim?

      Early settlement of your claim can dramatically affect the payment you are entitled to. Indications that your claim is ready for finalisation are: When you are fully recovered When your medical advisors advise your injuries have stabilised All evidence has been gathered and all documentation prepared The process will take approximately 2 years from the date of the accident although this may vary from claim to claim.


      Do you charge legal fees?

      Trewin Norman & Co. do not charge for your initial consultation. If no compensation is paid no legal fee will be charged for your claim. If you do receive compensation, legal fees will be claimed for at the time of settlement.
