What is considered in the property settlement process?

Considerations include fairness, asset distribution, contributions, and each party's future needs.

Is a consultation necessary for all cases?

Each case requires tailored advice, hence a consultation helps us understand individual circumstances better.

How will my estate be distributed in absence of a will?

If there is no will, then an administrator must be appointed by the Supreme Court of NSW to deal with the estate. They will distribute the estate in accordance with the rules contained in the Succession Act. These rules changed substantially in 2010 and can be very complex. For more information about the distribution of estates in the absence of a will, please see our legal wills page.

What happens if I don't have an estate plan?

If you have not planned ahead and put your affairs in order, then you may find that what happens to your estate is not at all what you would have desired. The Succession Act prescribes the process for distributing a person’s estate in the absence of a will. Should you become unable to make personal decisions for yourself, in the absence of an enduring guardian with whom you have discussed your wishes, your living situation and medical treatment may not be what you would have wanted. Put simply.

I am separating from my partner, will I have to go to court?

It is often the case that family law matters can be resolved outside of the court. Certainly that is our aim. If your situation is difficult and you are unsure about your entitlements, we will help you to understand your legal position and will try to facilitate a fair agreement between you and your former partner, including preparing you for mediation or conciliation and if agreement cannot be reached final hearing.

What defines a de facto relationship in property settlements?

Living together on a genuine domestic basis, duration, contributions, and seriousness of injustice if not settled.

Do I need a conveyancing lawyer to buy or sell my property?

No. You can go through a conveyancing-only firm. The advantage of using a law firm is that you have all bases covered in the event of a dispute with a vendor, purchaser or tenant. We can look after everything in the conveyancing process without you having to employ any additional specialists.

What qualifications do your lawyers have?

Our lawyers are accredited specialists in various areas of law including property, business, commercial litigation, and wills and estates.

How long does the property settlement process take?

The duration varies based on the complexity of the matter and the cooperation level of the parties involved.

What are the steps in obtaining a divorce?

This includes submitting the necessary paperwork and showing evidence of marriage breakdown.

Can you handle complex property matters?

Yes, our expertise also draws from general commercial and litigation law for complex property matters.

Do your lawyers appear in court?

Yes, our family lawyers regularly appear in both the Federal Circuit Court and the Family Court of Australia.

Can you represent clients with legal aid?

Yes, our lawyers are members of the NSW Legal Aid Family Law panel and represent clients in receipt of legal aid.
