We signed a 12 month lease however, we vacated property after 41 day. The land lord and the managing agent Tim Dwyer from Tim Dwyer Real Estate refused to clean up the Asbestos contamination in the back yard.
Despite 14 emails and dozens of phone calls to Tim Dwyer, no action was taken to decontaminate the back yard or to notify the land lord of their obligations. Each time we found a piece of Asbestos the land lord would send a contactor to collect it.
After finding dozens of pieces, Tim Dwyer agreed to pay for a professional Asbestos contamination inspection. The Asbestos inspector found numerous pieces of Asbestos in the back yard including one piece that was 300mm X 100mm.
Despite all the evidence of Asbestos contamination, including the professional Asbestos contamination report, Tim Dwyer from Tim Dwyer Real Estate turned up to the property denied any knowledge of contamination.
To make matters worse, Tim Dwyer refused to pay for the Asbestos contamination inspection despite his office explicitly, in writing, authorising the inspection. The land lord also refused to pay for the Asbestos contamination report as Tim Dwyer Real Estate had (apparently) not discussed the cost with the land lord.
Despite the land lord and Tim Dwyer holding the professional Asbestos contamination report for 14 days, neither party provided any written response to the report. So we moved out.
A couple of weeks later we lodged a VCAT application against the land lord and Tim Dwyer.
We attended a VCAT hearing and settled for a sum of $2500.00 which covered our moving costs, the professional Asbestos contamination report and rent paid in advance.
I am happy to provide copies of emails to Tim Dwyer, the VCAT application, the VCAT settlement documentation.
The way we have been treated by Tim Dwyer Real from Estate is an utter disgrace. Never deal with Tim Dwyer he is a disgraceful liar.
