Yard To Yard Fencing

I hired Yard to Yard fencing to replace the old wooden fence that it was shared with my next door neighbour. I chose Yard to Yard fencing because they were prompt to respond and their professional appearance. On the date, they replaced the fence, I was disappointed after they left and inspected their work to find my Rhododendron plant cut off, placed next to the fence. This plant was at 2.4mt from the actual fence. I was not told of the accident. They left some soil that they digged on the top of the woodchip of the garden bed. Another thing, I realised that now my neighbour got around 20cm more of land on her side. I knew that I could not say anything about the boundary because their condition 13 says : Any fence erected by Yard to Yard Fencing is not guaranteed to be the surveyed boundary.



I wrote to Scott asking to replace my plant or compensate for it. This is the reply I got:

“I'm sorry about your plant but it does say in my terms and conditions that we are not liable for any damages it's a pure accident sorry full payment required”

This what condition # 4 says: Yard to Yard Fencing will take all care but no responsibility for damages to underground services, e.g., stormwater; gas; electrical; optical; broadband; phone etc. It is the customers responsibility to obtain all required plans and clearance and will be held liable in the unlikely event of damage.



All of the conditions said about is a 0.5m boundary on both sides of fence. None of them made mention out of 0.5m.



I am still waiting for the plant to be replaced.

Now I know that I should make more questions about their conditions. I believe that companies have insurance to cover their damage caused by accidents.

Hired this business to do the fence and the gates. They will half finish the job and hold you to ransom to finish the work. They removed the gate on my property and left it lying on the ground and now demanding additional payment to fix the gate.
